The following terms and conditions apply to all orders and deliveries of products/services to ” Sleepwell “, En Roveray 198, 1170 Aubonne.

The purchase of Products (as defined below) is subject to the following terms and conditions. By ordering a product, you agree to these terms, without limitation or qualification. If you are ordering Products on behalf of a company, firm or organization, you represent and warrant that you are an authorized representative of that organization, with rights to accept the Terms, and agree to be bound by these Terms on behalf of that organization.

1. PRIVACY

We have put in place a privacy policy, which we refer you to, so that you can understand how we collect and use your data. You acknowledge that you have read and understand the Privacy Policy.

2. ACCOUNTS, REGISTRATION AND PASSWORDS

To facilitate future purchases on the site, you can create an account by entering an email address and password and other personal information. Please note that you can order items without create an account first. By creating an account, you agree that the information you provide to ” Sleepwell ” is accurate. Your account is personal, so by sharing it with a third party you take sole responsibility for all activities that occur under and with your personal data.

You are responsible for notifying us without delay in the event of a breach and/or suspected breach of your personal data at info@sleepwell.ch

3. PRODUCT INFORMATION

While we have taken all appropriate steps to present the products and their characteristics (such as color, patterns and textures, etc.) as accurately as possible through photos or other content on the site, what you see on your computer screen or other device is not an exact representation of the product you will receive. Consequently, the images that appear are not contractual and do not engage the responsibility of ” Sleepwell “. However, this clause does not limit your rights under statutory warranty claims.

4. ORDERING AND AVAILABILITY

To be able to order a product, you must be 18 years of age or older, or acting with the consent of your parent or other legal guardian.

You can place an order by clicking on the products you wish to purchase, then follow the instructions on the screen. You place your order by clicking on “basket”. Then, in the payment page, you must enter the necessary information and validate the purchase by clicking on the button provided for this purpose.

After placing an order, we will send you an e-mail with an order in which we confirm that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to purchase a product. All orders are subject to our acceptance. We are not obligated to accept your order, and we may, at our discretion, decline to accept an order. You acknowledge that you agree to pay by clicking on the “order” button for the product(s). If we accept your order, we will confirm this proposal by sending you an e-mail, in which it is confirmed that the product will be shipped. The contract between you and us in relation to the product(s) ordered will only be concluded when we send you the shipping confirmation. Once the contract is received, we are obliged by law to deliver the goods to you in accordance with the contract.

The contract will only cover the product(s) corresponding to the order confirmation. We do not store the text of the contract after the conclusion. You can print and save the contract information included in the shipping confirmation.

5. PRICE AND PAYMENT

The price of products that can be purchased on the site is displayed on the page. The prices are indicated all taxes and shipping costs included. However, if you are delayed in receiving your delivery, shipping charges may be added to the total amount due to the storage of the product(s).

Prices and express delivery charges (if any) are subject to change at any time. However, the changes do not affect orders for which we have already sent you a confirmation.

Payment for all orders is by credit or debit card on the payment page, or by invoice (BVR) at 30 days.

We accept payment with most credit and debit cards – including Visa, MasterCard, American Express, PayPal and Post Office – all listed at the checkout stage. The site currently uses third parties to process payments. Please note that online payment validation checks may be submitted by your card issuer and we take no responsibility if your card issuer refuses to authorize the payment for any reason. Please note that transactions may incur additional fees due to your card issuer. We take no responsibility for these additional charges.

All amounts are expressly stated in Swiss francs (CHF).

6. PROMOTIONAL CODES

“Sleepwell” may, from time to time, offer promotional codes on a variety of products for use when making a purchase on our site, while supplies last and subject to availability or other restrictions imposed by “Sleepwell”. Only promotional codes provided by ” Sleepwell ” are authorized and valid. They are not transferable and are for one-time use only, their validity being determined by ” Sleepwell “. Promotional codes cannot be combined, and customers may only use one promotional code per order. “Sleepwell is not responsible for lost, stolen or damaged codes. Promotional codes cannot be redeemed for cash or a financial equivalent. The monetary value of a promotional code will not be refunded or credited if all or part of the product(s) are returned. Codes are void if they are duplicated, transferred, sold, expired or for any other reason.

7. DELIVERY

See delivery conditions (appendix).

8. RISK AND OWNERSHIP

The ordered products are, from the date of delivery, at your entire charge. The ownership of the ordered products also passes to you as soon as we have received all amounts due in connection with the product(s), including shipping costs.

9. YOUR RIGHT OF WITHDRAWAL

You have a right of withdrawal, which can be exercised in accordance with the following provisions:

REVOCATION

For mattresses, you have a 100-day trial period from the date of delivery. In case of revocation, no justification is required. To exercise your right, you must send an e-mail to info@sleepwell.ch to clearly explain your decision to revoke the contract.

The 100 night trial does not apply to items such as comforters, pillows and mattress toppers.

EFFECTS OF THE REVOCATION

Only the amount of the mattress is refunded in full.

Any delivery and disposal costs for an old mattress (unless these were offered) or bank charges are not refunded.

The refund will be made as soon as (but no later than 3 business days after) the mattress is picked up and via the same payment method you used to make the purchase.

10. DÉFEDERAL PRODUCTS

Please check the product(s) immediately upon delivery. As soon as you or the authorized third party signs the acknowledgement of receipt, the goods are considered to be in conformity with your order, in perfect condition and without apparent defects. Only hidden defects must be reported without delay after their appearance in accordance with the rules of the Swiss Code of Obligations.

11. PRODUCT WARRANTY

The mattresses are guaranteed for 10 years, the bed bases are guaranteed for 24 months and the comforters and pillows are guaranteed for 12 months (see warranty conditions below) from the date of delivery.

The warranty benefits the original purchaser of the product and cannot be transferred to a third party.

MATRESS

The warranty covers all defects in material or workmanship, as well as damage resulting from normal use of the mattress for the first 24 months from the date of purchase. From the 3rd year on, the coverage decreases by 1/8 per year. In case of total replacement of the product, the current catalog price will be taken into account. The warranty period begins on the date of delivery.

EXCLUSION

Normal softening may result from regular use of the mattress and is not included in the warranty. A wrong choice of firmness at the time of purchase can in no way lead to the exercise of the guarantee. Also not covered by the warranty are: normal wear and tear of the mattress (a sagging of more than 15% of the height of the mattress, i.e. about 3 cm, is considered abnormal), improper treatment and use, damage due to transport or other damage such as stains, wrinkles, torn handles, defective zippers and slight differences in color. Damage to the mattress resulting from the use of an inappropriate or tired box spring does not qualify for warranty. Only items in good condition can be returned to us. For slatted bases supporting the mattress, the space between the slats may not exceed 60 mm and the use of a protective felt between the mattress and the slatted base is highly recommended. If a mattress rests on a two-piece slatted base, the slats must be mounted on a suspension and not create a hard spot in the center. It should be noted that since the mattresses are made of sensitive natural materials, they may have small differences in length or width. A tolerance of 2 cm in both directions is allowed.

SUMMERS

The bed bases are guaranteed for 2 years. The warranty covers all material and workmanship defects, as well as damage resulting from normal use of the bed frame.

EXCLUSION

Damage caused by improper use, batteries in electrical controls and dimensional errors are not covered by the warranty. The following are not covered by the warranty: normal wear and tear, improper treatment and use, transport damage or other damage such as scratches, dislodged slats and slight differences in color. Damage to the bed frame resulting from an inappropriate bed frame or support is not covered by the warranty.

PILLOWS/DUVETS

Only the guarantee for defects due to a manufacturing error or non-conformity with the product ordered is considered here.

EXCLUSION

All other warranty claims are excluded – in particular as a result of incorrect washing procedures and/or failure to follow washing instructions.

CLAIMS

Complaints regarding the occurrence and/or detection of a defect should be addressed exclusively in writing and as soon as possible to info@sleepwell.ch

“Sleepwell” reserves the right to use different fabrics in case the original ones are no longer available. The repair of a defective or damaged mattress or box spring will not, under any circumstances, have the effect of extending the initial duration of the warranty.

FEES

The customer is responsible for the costs of assembly and transport.

12. OTHER PROVISIONS

For all other provisions, the rules of the Swiss Code of Obligations shall apply.

13. ELECTRONIC COMMUNICATIONS

When you visit our site or communicate with us electronically, you agree to receive messages electronically.

14. CONTENT YOU PROVIDE TO SLEEPWELL

By leaving a comment on the site, you authorize ” Sleepwell ” to use it without restriction or royalty, including for the promotion and marketing of our products. Only your first name will be published, all other personal data will be deleted to preserve your anonymity. “Sleepwell” reserves the right to shorten your comment.

15. CHANGES TO THESE TERMS AND CONDITIONS

These terms and conditions are subject to change without notice without affecting contractual obligations.

16. COMPLETENESS OF THE AGREEMENT

These terms and conditions, together with any documents incorporated herein, constitute the entire agreement between you and Sleepwell. Only the contracting parties are affected by this agreement.
